As many of you know, the Form I-9 was set to expire on August 31, 2012. We have received numerous calls wondering what form employers are to use now that the current one has expired.

Form I-9 must be filled out for all newly hired employees to verify their identity and ensure that the individual is legally authorized to work in the United States. Information on the form provides for proof of that authorization.

The US Citizenship and Immigration Service recently announced that employers are to continue to use the current Form 1-9 even past the expiration date as the new form layout is not ready.

In March of 2012, the USCIS requested comments on the current Form 1-9 and a proposed revised layout. Responses were due by May 29, 2012.  Apparently, in the usual government style as it relates to deadlines, USCIS must still be working on the project.
