E-Verify is an Internet-based program run by the Federal government that was implemented to eliminate the hiring of illegal aliens by US employers. The system compares information from employee’s Employment Eligibility Verification Form I-9 to data from U.S. government records. If the information matches, that employee is eligible to work in the United States. If there is a mismatch, E-Verify alerts the employer and the employee is allowed to work while he or she resolves the problem. The employee works with their employer to resolve the mismatch within eight work days from the response date. The program is operated by the Department of Homeland Security (DHS) under the US Citizenship and Immigration Services in partnership with Social Security Administration

The Federal government and most states require the use of E-Verify in hiring state agency employees and contractors. Use in the private sector of E-Verify has been growing as, according to the DHS, more than 600,000 employers now use E-Verify with many companies enrolling in the program every week. Developed starting in 1997, DHS now claims a 98% accuracy rate in the E-Verify system.

E-verify requirements vary from state to state. (See Advi$or article on E-Verify). As immigration regulations become a bigger issue, State laws regarding E-Verify requirements do change. States like Alabama and South Carolina require all employers to utilize E-Verify. States like Tennessee and North Carolina require employers to utilize E-Verify or some form of documentation (See 2017 Advi$or Article re Tennessee). In contrast, California has a law which restricts the use of E-Verify.

The E-Verify system is offered free by the DHS. The system does require enrollment into the program. The US Citizenship and Immigration Services site will have more information.
